TERMS OF SERVICE 2025 for ElleRuss.com courses, programs, products, and services

1. Overview
   These Terms of Service (“Terms”) govern your purchase and use of any programs, courses, products, services, and materials offered by Elle Russ (“Company,” “we,” “us”). By purchasing or accessing anything from us, you agree to these Terms and our Privacy Policy.

2. Eligibility
   Our offerings are for individuals 18+.

3. Not Medical Care
   Content and sessions are educational/patient-advocacy only. We do not diagnose, treat, prescribe, or provide medical care. No doctor–patient relationship is created. For medical questions, consult a licensed clinician.

4. Offer Types
   a) Courses and digital programs (self-paced or cohort)
   b) Live sessions (webinars, group coaching, Q&A)
   c) One-to-one services (e.g., Thyroid Clarity Calls, Thyroid Care Rx)
   d) Downloadable materials (workbooks, PDFs, replays)

5. Access Duration (including “Lifetime” access)
   a) The Ultimate Thyroid Course: “Lifetime access” means a guaranteed minimum of two (2) years from your purchase date. After that, we may continue access at our discretion. We reserve the right to retire, migrate, or discontinue the course or platform at any time after that minimum without further obligation.
   b) The Ultimate Confidence Course: “Lifetime access” means a guaranteed minimum of two (2) years from your purchase date on the same terms as above.
   c) Masterclasses and limited-term products: If specified on the checkout page (e.g., 60 days), that specific window governs.
   d) Platform changes: We may change platforms, URLs, or delivery methods; reasonable equivalents count as continued access. If we sunset a product after the guaranteed window, access may end without refund.
   e) Account standing: Access requires your account to be in good standing (no chargebacks, fraud, or TOS violations).

6. Community & Live Sessions
   Treat others with respect. No harassment, spamming, or solicitation. We may remove anyone who disrupts, violates confidentiality rules, or breaches these Terms.

7. Intellectual Property
   All content is owned/licensed by us. You receive a personal, non-transferable license for your own use. You may not copy, share, repost, sell, or repurpose our materials without written permission. Passwords are single-user only.

8. Thyroid Clarity Calls – Service Rules
   a) Purpose: educational/advocacy clarity on your thyroid journey. Not medical care or treatment.
   b) Duration: 30 minutes max per booking.
   c) Boundaries: No post-call texts or emails (“just one quick question” included). To continue, book another call.
   d) Recording: You may record for personal use only. Do not distribute or publish.
   e) Rescheduling: You may reschedule anytime before the scheduled start time via your confirmation link; no fee.
   f) No-shows: If you miss the call without rescheduling before the start time, the session is forfeited.
   g) Multiple bookings: You may book as many Clarity Calls as you like, subject to calendar availability.

9. Payments, Installments, and Refunds
   a) Payment is due at checkout. If you’re on a payment plan, you authorize us (and our processor) to charge each installment on schedule.
   b) All sales are final. We do not offer refunds on digital products, courses, masterclasses, or services.
   c) Chargebacks: Filing a chargeback violates these Terms. If you initiate a chargeback, your access to all products—“lifetime” included—is revoked pending resolution. We may report delinquency consistent with law.

10. Promotions & Bonuses
    Any bonus items (e.g., extra calls, mini-courses, or communities) are discretionary, may change, and do not extend access guarantees.

11. Technology & Availability
    We aim for reliable access but don’t guarantee uninterrupted service. Outages, maintenance, third-party downtime, or platform changes may occur.

12. Disclaimers; Limitation of Liability
    Offerings are provided “as is” without warranties. To the maximum extent allowed by law, we disclaim implied warranties (merchantability, fitness, non-infringement). We are not liable for any indirect, incidental, special, or consequential damages, loss of profits, business interruption, data loss, or health outcomes. Your use is at your own risk.

13. Indemnification
    You agree to indemnify and hold us harmless from claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from your use, breach, or misuse of the offerings or materials.

14. Testimonials, Media, and Communications
    If you voluntarily submit a testimonial, comment, image, audio/video, or appear on live sessions, you grant us a nonexclusive, worldwide, royalty-free license to use it for marketing and educational purposes. You can request removal prospectively by emailing us; prior uses may remain.

15. Privacy
    We handle personal information under our Privacy Policy (linked in checkout/footer). Third-party processors (e.g., Kajabi, Stripe, PayPal, email providers) process data under their terms.

16. Confidentiality in Groups
    Respect the privacy of fellow participants. You may discuss your own takeaways; do not share others’ personal stories or identifiable details.

17. Dispute Resolution; Governing Law
    These Terms are governed by California law. Any dispute will be resolved by binding arbitration in Los Angeles County, CA before a single arbitrator under the American Arbitration Association rules. The prevailing party may recover reasonable attorneys’ fees and costs. You waive jury trial and class actions.

18. Non-Disparagement
    If a dispute arises, discuss it with us privately. Public disparagement (including social media) about unresolved disputes breaches these Terms.

19. Changes to Terms
    We may update these Terms at any time. The current version posted on the site governs going forward.
